Easement type
A temporary easement gives a working area alongside the permanent strip for the construction period. It ends, but what it leaves behind sometimes does not.
A right to occupy and use a defined area for a defined period, to build the facility that the permanent easement will house. It usually runs alongside the permanent strip and it frequently doubles the width of ground actually disturbed.
Ordinarily as compensation for the use of that area over the period it lasts, plus any damage that remains once it ends. Where construction interrupts a crop or a grazing season, that loss belongs in the discussion.
A temporary easement without a stated end date is not temporary in any useful sense. Pin down the duration and what happens if the work overruns.
Specify what restored means: topsoil separated and replaced in order, compaction relieved, contours returned, seed mix and rate, fence standard, and who signs off. General language about restoring to a similar condition is difficult to enforce a year later.
The two that recur are overrun and compaction. Work that was to last one season lasts two, and ground that looks restored produces less for several years afterwards. Both are easier to address in the document than in a claim afterwards.
