Common commercial concerns

  • Frontage taken for a widening, with the building left closer to the road.
  • Driveways closed or relocated, or a median that removes left turns.
  • Parking count reduced below what the use requires.
  • Truck circulation or loading area cut.
  • Signage and visibility affected.

Access and turning movements

For a site that depends on passing trade, the ability to turn in from both directions is close to the whole business model. A raised median or a channelised entry changes what a buyer would pay for the site, and that change belongs in the after value.

Count what actually changes

Traffic counts, delivery routes and photographs of entries taken before construction are the strongest evidence of what the access was. They are much harder to reconstruct afterwards.

Parking and circulation

Where a taking pushes parking below the ratio a use requires, the remainder may no longer support the same tenant mix. That is a valuation question, not merely an inconvenience, and it should appear in the appraisal.

Fixtures and improvements

Items attached to the realty are compensated as part of the property rather than moved at your expense. Canopies, racking, paving, pylon signs, walk in coolers and specialised tenant improvements commonly qualify. An inventory prepared early avoids arguments later.

Tenants and leases

The condemnation clause in each lease decides how proceeds are apportioned and whether the lease terminates on a taking. A business tenant may hold separate claims for fixtures or a leasehold interest even though it owns no land.
